澳洲留学澳大利亚学生签证的重大变革

 　　据留学了解到最新消息，今晨澳大利亚政府出台了由HonMichaelKnight所撰写的长达196页的报告。这意味着澳大利亚学生签证将会在不久的将来产生重大的变革。由于最近两年澳大利亚政府希望澳大利亚的留学和移民分家，加上澳币上涨，全球金融危机导致美元下跌，美国大量吸收以中国学生为主的国际学生。因此为了简化澳大利亚学生签证流程，保持澳大利亚留学市场在国际的竞争力，从去年开始澳大利亚移民局经过多方咨询，HonMichaelKnight对国际学生政策改变的建议报告。澳大利亚移民局已表示将全盘接受报告中的41项建议。这些建议将于2012年第二学期之前实施。　　这41个建议中主要的33个建议的英文总结如下：

　　1.ThefirstcriterioninassessingaStudentvisaapplicationiswhethertheapplicantisagenuinetemporaryentrant;

　　2.AsuccessfulapplicantmustbebothagenuinetemporaryentrantandagenuineStudent;

　　3.AllapplicantsforhighereducationBachelorsdegree(2+2or3+1arrangementswithpartneruniversities),andMastersdegreebycourseworkshouldbeAssessmentLevel1(includingpackageswithELICOSorfoundationcourses);

　　4.AllAustralianBachelorsdegreegraduates(withatleasttwoyearsstudyinAustralia)begiventwoyearspost-studyworkrightsinAustralia;

　　5.AllHigherDegreebyResearch(HDR)students(visaSubclass574)betreatedasAssessmentLevel,andbegiventhreeyearsworkrights;

　　6.MastersbyResearchgraduatesbegiventhreeyearspost-studyworkrights,andPhDgraduatesbegivenfouryearspost-studyworkrights;

　　7.HDRstudentsbeallowedtoextendtheirstudentvisaforuptosixmonthstoallowfortheinteractivemarkingprocess.ThisshouldalsoapplytoPHDSubclass576visaholdersifAusAIDispreparedtofundtheextension;

　　8.ThethresholdEnglishlanguagetestrequirementsforstandaloneELICOSstudentsberemoved;

　　9.TheEnglishlanguagerequirementsforschoolstudentsinAL4bethesameasthoseapplyingforAL1throughtoAL3andtheassociatedwaiverschemeabolished;

　　10.ThemaximumaschoolstudentvisaholdercanstudyEnglishbe50weeksacrossallALs;

　　11.Thecurrentrestrictionsonstudentguardiansofamaximumofthreemonthsofstudybemaintainedbutunlimitedpart‐timestudyrightsforELICOSstudyonlybeallowed;

　　12.Pre‐paidhomestayfeesbeincludedinfinancialassessmentsonthesamebasisaspre‐paidboardingfees;

　　13.AsamatterofsomeurgencyAusAID,DIAC,DOHAandotherrelevantAustraliangovernmentagenciesdevelopanintegratedpolicyinrelationtotheawardofscholarshipsandhowvisaarrangementsforawardeesaretobemanaged.InparticulartheyshouldaddressthesituationofpotentialawardeeswhohaveadisabilityorHIV;

　　14.ThatDIACandDEEWRmeetwithstateeducationauthoritiestoworkoutwhatcanbedonetoavoidthesituationwhereavisaforachilddependentcannotbegranteduntilproofofenrolmentispresentandstateeducationauthoritieswillnotgrantsuchproofuntilproofofvisagrantismade.AnyagreedremedyshouldapplyacrossallStudentvisasubclasses;

　　15.Streamliningapplicationsforsemesterofyearlonguniversitynon-awardcourses;

　　16.DIACbeappropriatelyfundedtofurtherdevelopresearchcapabilityacrosstheprogram;

　　17.Intheeventthattheresearchoverthenext12monthsrevealssystemicabuseofdependant(secondaryapplicant)visas,thatthegovernmentseriouslyconsidermirroringtherecentUKpolicyandrestrictdependantvisastoMastersandabovecoursesunlesstheprimaryapplicantissponsoredbyagovernment;

　　18.CurrentarrangementswherebyStudentCourseVariations(SCVs)automaticallybecomeNCNsshouldcease.SCVinformationshouldcontinuetobeconveyedtoDIACwhoshoulduseitasaninputintoamoretargetedandstrategicanalysisofnon‐compliance;

　　19.AutomaticcancellationofstudentvisasshouldbeabolishedandreplacedbyasysteminwhichinformationconveyedbySCVsisusedasaninputintoamoretargetedandstrategicanalysisofnon‐compliance;

　　20.Themandatorycancellationrequirementforunsatisfactoryattendance,unsatisfactoryprogressandworkinginexcessofthehoursallowedshouldberemoved,givingDIACofficersthediscretiontodeterminecancellationinparticularcasesontheirmerits;

　　21.DIACshouldconcentrateitscomplianceandintegrityresourcesinrelationtoStudentvisasonthehighestriskareas;

　　22.DIACshouldnotonlyrespondtoinformationgeneratedbyPRISMSbutalsobeproactiveindetectingthesortsofbreaches(forexampleshammarriagesandexceedingpermissibleworkhours)whicharenotreportedinPRISMS;

　　23.Thatstudentworkentitlementsbe40hoursperfortnightinsteadof20hoursperweek;

　　24.Thenecessarylegislativechangesbemadetorequirethenameofanyagentinvolvedtobeenteredintothestudent’sdataintoPRISMS,andDEEWRtakestepstoencourageproviderstovoluntarilyenteragentdataintoPRISMSintheinterimbeforetheESOSActischangedtomakethismandatory;

　　25.ThatDEEWRandDIACestablishasinglestudentidentifiertotrackinternationalstudentsthroughtheirstudiesinAustralia;

　　26.ThatDIACundertakeareviewoftheALframework,withamindtoeitherabolishingthesystementirelyormodifyingheframeworktomakeitrelevanttocurrentandfuturechallengesfacingthestudentvisaprogram.ThisreviewshouldbemanagedbyDIACbutshouldincludereferencetoanexternalpanelorreferencegroup;

　　27.ThatDIACupgradeitsliaisonatoverseaspostswithmigrationandeducationagentsinrelationtothestudentvisaprogram,includingregularmeetingstokeepagentsabreastofanychangesinrulesandprocedures;

　　28.ThattheprovisionofoffshoreVETsectoreducationbeinvestigated;

　　29.ThatDIACconstituteanEducationVisaAdvisoryGroupasaprimarymeansofregulartwowaycommunicationbetweenstakeholdersintheinternationaleducationsectorandDIAC;

　　30.ThepolicyregardingPre‐VisaAssessment(PVA)bediscontinued;

　　31.Studentvisasbeallowedtobegrantedinadvanceoffourmonthsbeforethecommencementoftherelevantcourse.Wherenecessary,visasshouldspecifyadatebeforewhichtheholdercannotenterAustralia;

　　32.ThatDIACregularlyreviewsthecurrentlivingcostamount,andbasedontheCPIorothermeasureamendtheamount,asrequired;

　　我们翻译了其中一些和大家息息相关的重要条款。

　　第1条，审理学生签证最重要的第一个标准-是否申请人是真正的临时签证入境者。

　　第3条，所有的高等教育本科学位课程(包括2+2，3+1合作项目)，授课类研究生课程应属于ASSESSMENTLEVEL1(包括与语言和大学预科课程打包类的申请)。(备注：风险级别为1的话，就意味着不用雅思，不用存款时间的那个等所有麻烦事。)

　　第4条，所有的澳大利亚本科学位毕业生(至少2年的澳大利亚学习)应该在毕业后获得2年的工作权利。

　　第6条，所有的澳大利亚BYRESEARCH持有574签证的毕业生应该在毕业后获得3年的工作权利，PHD博士毕业生应该在毕业后获得4年的工作权利。

　　第7条，HDR类申请人和576签证持有人将可以延长六个月签证用于最终论文的评分。

　　第8条，语言类课程签证移除对于语言能力的要求。(备注：可以理解为不用要雅思了。)

　　第9条，对于中学类571签证申请人的英文要求，AL4级别的申请人将和AL1到AL3的相同，并且取消相关的减免计划。

　　第10条，对于全部级别的申请人，中学类签证持有人最长可以就读50周语言课程。(备注：比原来增加了不少时间，对于基础差的同学是很好的消息。同时对于一些想等待名校空位的同学也有了更充足的时间。)

　　第11条，对于学生监护人签证持有人，最长三个月学习的规定保留，但对就读parttime的语言课程没有任何限制。(备注：澳洲政府在尽可能的帮助教育产业啊。从此条改变可以看出。)

　　第12条，预先支付给寄宿家庭的费用可以等同于预先支付给寄宿学校的费用，以支付的费用不用在资金证明中再次提供。

　　第17条，研究表明，很多人在不法利用配偶陪读签证。澳大利亚政府考虑借鉴英国最近的政策，只有读硕士课程或以上学位的学生才可以申请其配偶的陪读签证，或者主申请人是由政府担保资助的。

　　第19条，学生签证自动取消政策应该被取消，取而代之的应该是一个更有效的评估系统。

　　第20条，由于学生出勤率，学习进度以及超时工作而产生的强制性学生签证取消应该被废除，应该给签证官更大的酌情权来根据个案决定是否取消签证。(备注：这个绝对不代表来澳洲政府对国际学生出勤率，学习进度或是打工时间的放松规定。)

　　第23条，留学生工作时间长度，由原来的每周最多20小时，变更为每两周40小时。

　　第26条，有可能取消或更改现有的国家按照风险等级区分的政策。

　　第30条，取消PVA。

　　第31条，学生签证可以在课程开学前4个月获批，如有必要，签证标签会注明申请人在具体日期前不能进入澳大利亚国境。

　　澳大利亚政府准备在2011-2013年期间实现完成所有的改革，主要的改革项目或在明年7月1日前完成。
