bysurveyreportissuedbyaninspectionorganizationagreeduponbybothparties,withtheexception,however,ofthoseclaimsforwhichtheinsurancecompanyand/ortheshippingcompanyaretobeheldresponsible.ClaimforqualitydiscrepancyshouldbefiledbytheBuyerswithin30daysafterarrivalofthegoodsattheportofdestination,whileforquantity/weightdiscrepancyclaimshouldbefiledbytheBuyerswith15daysafterarrivalofthegoodsattheportofdestination.Thesellersshall,within30dyadsafterreceiptofthenotificationoftheclaim,sendreplytotheBuyers.

13.ForceMajeure:IncaseofForceMajeure,thesellersshallnotbeheldresponsibleforlatedeliveryornon-deliveryofthegoodsbutshallnotifytheBuyersbycable.TheSellershalldelivertotheBuyersbyregisteredmail,ifsorequestedbytheBuyers,acertificateissuedbytheChinaCouncilforthePromotionofInternationalTradeor/andcompetentauthorities.

14.Arbitration:AlldisputedinconnectionwiththisContractortheexecutionthereofshallbesettledbynegotiationbetweentowparties.Ifnosettlementcanbereached,thecaseindisputeshallthenbesubmittedforarbitrationinthecountryofdefendantinaccordancewiththearbitrationregulationsofthearbitrationorganizationofthedefendantcountry.Thedecisionmakebythearbitrationorganizationshallbetakenasfinalandbindinguponbothpartied.Thearbitrationexpensesshallbebornbythelosingpartyunlessotherwiseawardedbythearbitrationorganization.
